Athletic/Recreational Release Agreement
The Fernandez Family Center for Leadership and Wellness offers the opportunity to participate in a wide variety of recreational and fitness activities. All participants should be aware that many recreational and fitness activities involve substantial risks of bodily injury, property damage, and other dangers associated with participating inherent in such activities as well as in any training, preparation for, and travel to and from such activities.
In consideration of being permitted to access and/or participate in any activity at, or in any way related to, the Fernandez Center, the undersigned voluntarily assumes all risks of damages or injury that may be sustained by the participant while traveling to or participating in any activity in any way related to the Fernandez Center. The undersigned further agrees to release St. Thomas University, Inc., its corporate members, directors, officers, employees, agents, and affiliates from any claims of whatever kind arising from participation in, or in any way connected with, any recreational or fitness activities at the Fernandez Center.
The undersigned acknowledges that all participants are required to comply with all of St. Thomas University's rules and standards of conduct and that St. Thomas University has the unrestricted right to terminate the participation of any person in ay activity at the Fernandez Center.
The undersigned hereby grants St. Thomas University and its agents full authority to take whatever action is deemed necessary for the health, safety, and welfare of participants, including the provision of medical treatment. The undersigned hereby consents to any such treatment and waives any claims allegedly arising therefrom.
The undersigned hereby grants to St. Thomas University the right to photograph and/or videotape participant and to use participant's name, face, likeness, voice, and/or appearance in connection with exhibitions, publicity, advertising, and promotional materials without any reservation, limitation, or additional consideration. This waiver specifically releases any common law causes of action or claims under Fla. Stat. 540.08 and expressly constitutes written consent for publication of participant's name, face, likeness, voice, and appearance.
The undersigned has read this Athletic/Recreational Release Agreement and agrees to be bound to its contents.
